A recent article suggests that franchisors in the U.S. And Ontario are in danger of being classed as joint employers. These developments, which follow America’s National Labor Relations Board’s 2014 recommendation that McDonalds USA LLC be named as joint employer in actions brought by employees of franchisees, and the NLRB’s 2015 revision by the standard for determining joint employer status, mean that franchisors may conceivably be exposed to claims from employees of their unit franchisees for wrongful dismissal wage claims and human rights violations and suchlike.
